Terms of Service

These terms are an agreement between you and [Legal name of the operator], which operates Pravia Digital ("Pravia", "we", "us"). Please read them together with our Privacy Policy and Refund & Cancellation Policy.

1. About these terms

By creating an account, buying a plan, or using a storefront hosted on https://www.pravia.digital, you agree to these terms. If you are using Pravia on behalf of a business, you confirm that you are authorised to accept these terms for that business. If you do not agree, please do not use the service.

2. What Pravia is (and is not)

Pravia is a software platform that lets businesses create a public digital storefront showing their details, products and contact options, and receive enquiries from visitors.

  • Pravia is not the seller of any product or service shown on a storefront.
  • Storefronts have no cart or checkout. Pravia does not take orders or process payments between visitors and businesses. Any purchase, price, delivery, warranty, return or refund for a product is agreed directly between the visitor and the business.
  • Information on a storefront, including prices, stock, offers and coupons, is provided by the business. Pravia does not verify it.

3. Terms for storefront visitors

  • You may browse storefronts for personal or business purposes.
  • When you submit an enquiry, catalogue request or offer form, you must give your own, accurate details.
  • Offers and coupon codes are made by the business. The business decides whether and how to honour them. Pravia is not responsible if a business changes or withdraws an offer.
  • If you have a problem with a business, contact it directly. If you think a storefront is misleading, fraudulent or unlawful, please report it to us (see Contact).

4. Business accounts

  • You must be at least 18 years old and able to enter into a binding contract under Indian law.
  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your password secret and for all activity under your account. Tell us promptly if you suspect unauthorised access.
  • Each storefront address (its "slug") is allocated on a first-come basis. We may reclaim or change an address that infringes someone else's rights or is misleading.

5. Your content

You keep ownership of the text, images, logos and other material you upload ("your content"). You give Pravia a non-exclusive, worldwide, royalty-free licence to host, store, copy, resize, format, display and distribute your content as needed to run your storefront, generate your catalogue PDF, help search engines find your storefront and provide the service. The licence ends when your content is deleted from the service, except for copies held in routine backups for a limited time.

You are responsible for your content and confirm that:

  • you own it or have permission to use it;
  • it is accurate, including prices, availability, offers and business details; and
  • it complies with applicable laws, including consumer protection, advertising, legal metrology and intellectual property laws.

Visitor data. Enquiries and offer sign-ups you receive contain visitors' personal data. You must use them only to respond to the visitor and, where the visitor consented, to contact them about your offers, in line with applicable law including the Digital Personal Data Protection Act, 2023. You must honour requests from visitors to stop contacting them.

6. Acceptable use

You must not use Pravia to:

  • list goods or services that are illegal, counterfeit, stolen or restricted without the required licence;
  • publish false, misleading, defamatory, obscene, hateful or harassing content;
  • impersonate another person or business, or use trademarks you are not entitled to use;
  • collect visitors' data under false pretences or for purposes other than those disclosed;
  • upload malware, or attempt to access other accounts, data or systems you are not authorised to access;
  • overload, scrape, reverse engineer or interfere with the service, or bypass usage or plan limits; or
  • send spam or unsolicited messages using details obtained through Pravia.

We may remove content or restrict storefronts that break these rules, in line with our obligations under the Information Technology Act, 2000 and its rules.

7. Plans, payments and renewal

  • Paid plans (Starter, Growth and Premium) are bought for a fixed, prepaid period: 30, 90, 180 or 365 days. Plan features and limits, such as the number of products, images per product and categories, are shown when you choose a plan.
  • Prices are in Indian Rupees and are shown before you pay. Payments are processed by Razorpay.
  • No automatic renewal. Plans do not renew or charge you automatically. When the period ends, you can buy a new plan to continue.
  • Your storefront is published after a successful payment. When a plan expires and is not renewed, your storefront may be hidden from the public. Your account and content are kept so you can renew.
  • Upgrades: if you move to a higher plan during an active period, the unused value of your current plan is credited toward the price of the new plan, as shown before you pay.
  • Refunds are covered by our Refund & Cancellation Policy.
  • We may change prices for future purchases. Changes do not affect a period you have already paid for.

8. AI features

  • Pravia includes AI tools that draft text such as business and product descriptions. Usage is measured in credits, which are allocated monthly according to your plan. Credits have no cash value, cannot be transferred or refunded, and unused credits do not carry over to the next month.
  • AI output can be inaccurate, incomplete or unsuitable. You must review AI-generated text before publishing it and you are responsible for anything you publish.
  • Text you submit to AI tools is sent to our AI provider (Google) to generate the result, as described in our Privacy Policy.

9. Search engines and visibility

Pravia structures storefront pages so search engines can find them, and submits published storefront addresses to Google. However, search engines decide independently whether, when and where to show any page. Pravia does not guarantee that your storefront will be indexed, ranked or shown for any search, or that it will bring any number of visitors, enquiries or sales.

10. Availability and changes to the service

We work to keep Pravia available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages at our service providers or events beyond our control may affect the service. We may add, change or remove features. If we remove a core feature of a plan you have paid for, we will tell you and offer a fair remedy.

11. Suspension and termination

  • You can stop using Pravia at any time. To have your account and data deleted, contact us.
  • We may suspend or close an account, or unpublish a storefront, if you seriously or repeatedly break these terms, if required by law or a lawful order, or to protect visitors or the service. Where reasonable, we will tell you first and give you a chance to fix the problem.
  • If we close your account without cause, we will refund the unused part of your current plan. If we close it because you broke these terms, no refund is due.

12. Pravia's intellectual property

The Pravia platform, software, design, templates and brand belong to us or our licensors. These terms do not give you any rights in them, other than the right to use the service as described here.

13. Disclaimers

To the extent permitted by law, the service is provided "as is" and "as available". We are not responsible for the products, services, prices, offers, conduct or content of businesses on Pravia, or for any dealings between visitors and businesses. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.

14. Limitation of liability

To the extent permitted by law, Pravia is not liable for indirect or consequential losses, such as loss of profits, revenue, business or data. Our total liability to a business for any claim relating to the service is limited to the amount that business paid to Pravia in the 12 months before the claim arose. These limits do not apply to liability that cannot be limited by law, including for fraud.

15. Indemnity

If you are a business, you agree to compensate Pravia for reasonable losses and costs arising from claims by third parties caused by your content, your products or services, your use of visitors' data, or your breach of these terms.

16. Governing law and disputes

These terms are governed by the laws of India. Before starting formal proceedings, please contact us so we can try to resolve the issue. Subject to any rights you have under consumer protection law to bring a complaint elsewhere, the courts at [City] have exclusive jurisdiction.

17. Changes to these terms

We may update these terms. The "Last updated" date shows when they last changed. For significant changes, we will give businesses reasonable notice by email or in the dashboard. Continuing to use Pravia after changes take effect means you accept them.
